Learned counsel appearing for the petitioners submits that so far as prayer Nos. (i) and (ii) are concerned, these prayers have become infructuous and now this writ petition, filed under Article 226 of the Constitution of India only survives for prayer No. (iii), wherein it has been prayed to provide the benefits in terms of the rehabilitation policy.

In view of the counter affidavit filed on behalf of the State, the matter is required to be considered by the authority concerned at the first instance. As such, this writ petition is disposed of directing the petitioners to file a fresh representation before the respondent No. 8 within three weeks from today and if the said representation is being filed within the aforesaid period, the respondent No. 8 shall take final call on the said representation and pass an appropriate order within eight weeks thereafter.

This writ petition is disposed of.
