Ms. Radha Arya, Advocate, for the petitioner. Mr. P.S. Bisht, Brief Holder, for the State. (2) Petitioner runs an ice factory. He is aggrieved by an inspection report dated 29.4.2026. In the inspection report, allegation of theft of electricity is made against the petitioner. Petitioner contends that the said allegation is incorrect, as the factory commenced production only from 1st of April, 2026. Thus it is contended that amount indicated in the report is unbelievable, as consumption of electricity amounting to the tune of ₹2,30,55,120 is not possible within a few days. (3) This Court is not inclined to go into the issue raised by the petitioner. The report challenged by the petitioner is based on an inspection. Learned State Counsel is right in submitting that the penalty order is yet to be passed in the matter and if penalty order is passed, then it can be challenged before appellate authority under the Electricity Act.
