Mr. Prakash Chandra, Advocate for the petitioner. 2. Mr. Pan Singh Bisht, Brief Holder for the State of Uttarakhand. 3. By means of this writ petition, petitioner has sought the following relief:- “I. Issue a writ, order or direction in the nature of Mandamus directing and commanding the respondents to conduct and complete the demarcation (Paimaish) of the petitioner’s land comprising Khasra No. 2111, area measuring approximately 36 bighas situated at Village KhediShikohpur, Tehsil Bhagwanpur, District Haridwar, within a time-bound period as may be fixed by this Hon’ble Court and to submit a compliance report thereof.” 4. Perusal of the record reveals that petitioner has made application for measuring his land to the Deputy Director, Consolidation. 5. Learned State Counsel submits that petitioner wants to regain possession of the land, which is occupied by some other person, through demarcation. He submits that if any part of petitioner’s land is encroached upon by some other individual, then the only remedy available to him is to file suit under Section 209 of Zamindari Abolition and Land Reforms Act. UKHC010112312026 2026:UHC:5480 6. This Court finds substance in the said contention. 7. Petitioner wants to achieve some other purpose under the garb of demarcation. There is no application made by petitioner under Section 41 of Land Revenue Act. Thus, the direction sought by petitioner cannot be issued. The writ petition fails and is dismissed.
