Romesh Verma, Judge(oral) After hearing for some time, learned counsel for the respondents submits that on instructions he may be permitted to withdraw the application, which was filed by the defendants/respondents under the provisions of Order 8 Rule 1 A (3) C.P.C. As per learned counsel the application does not contain all the details and averments which are required to be proved in the case at hand 2. The said submissions of learned counsel for the respondents are opposed by the learned counsel for the petitioner. Needless to say, the present petitioner shall have the right to oppose the said fresh application on all the available grounds. 4. In view of above, present petition stands disposed off.
