M/s.Rajeswari Karthikeyan for R-3 ORDER This Writ Petition has been filed seeking to forbear the 4th respondent from conducting Katta panchayat and consequently direct the 1st to 3rd respondents to take appropriate action against the 4th respondent based on the petitioner’s representation dated 10.11.2025 in the light of the order passed by this Court in case of K.Gopal -Vs- The State of Tamil Nadu & Ors. reported in 2005 (3) MLJ. 2. Mr.R.Murthi, learned Government Advocate takes notice on behalf of the 1st and 2nd respondent. M/s.Rajeswari Karthikeyan, learned counsel takes notice on behalf of the 3rd respondent. It is the case of the petitioner that the marriage between the petitioner’s daughter namely Shahnaz and the 5th respondent was solemnized on 23.01.2025 as per the Muslim Rites and Customs. However, due to a matrimonial dispute between them, the 5th respondent issued triple talaq notice to the petitioner and approached the 4th respondent seeking dissolution of the marriage. Pursuant thereto, the 4th respondent initiated proceedings in respect of the said issue, is attempting to adjudicate the matter by way of a Kangaroo court thereby threatening the petitioner and illegally proceeding with the talaq proceedings. In this regard, the petitioner submitted a representation dated 10.11.2025 respondents 1 to 3 seeking to take appropriate action against the 4th respondent. However, the said representation has not been considered till date. Aggrieved by which, the petitioner has come up with the present Writ Petition. 4. Learned counsel appearing for the petitioner submitted that the 4th respondent is governed by the provisions of Wakf Act, 1995 under the control of the 3rd respondent Board and does not have any authority to adjudicate matrimonial disputes. He further submitted that any such attempt by the 4th respondent to conduct proceedings by way of “Kangaroo Court” with regard to matrimonial disputes is without jurisdiction and therefore, it is prayed that appropriate directions may be issued restraining the 4th respondent from conducting any such proceedings and interfering in the matrimonial disputes between petitioner’s daughter and the 5th respondent. __________ Page3 of 6 https://www.mhc.tn.gov.in/judis WP No. 8233 of 2026 5. On the above contentions, this Court heard the learned counsel for the respondents who have no objections to the said order being passed. 6. In view of the aforesaid submissions, this Court without expressing any opinion on the merits of the case, directs the respondents 1 to 3 to consider the petitioner’s representation dated 10.11.2025 seeking necessary action against the 4th respondent with regard to conduct of proceedings by way of “Kangaroo Court” and pass appropriate orders on the same in accordance with law, within a period of four (4) weeks from the date of receipt of a copy of this order. Further, there shall be a direction to the 4th respondent not to conduct any proceedings by way of Kangaroo Court relating to matrimonial disputes. However, liberty is granted to the petitioner’s daughter and the 5th respondent to work out the remedy in the manner known to law with regard to the matrimonial dispute between them. 7.The Writ Petition stands disposed of in the above terms.
