--Respondent
Hon’ble Manoj Kumar Tiwari, J.
Mr. Rajesh Sharma, Advocate, for the petitioner. (2) Petitioner filed a suit for permanent injunction along with an application seeking temporary injunction. His temporary injunction application was rejected by the Trial Court by holding that petitioner could not prove its prima facie case. Miscellaneous appeal filed by the petitioner too has been dismissed. Thus feeling aggrieved, petitioner has approached this Court. (3) Upon perusal of impugned judgments and orders, passed by Courts below, this Court do not find any scope for interference. Law is well settled that grant of temporary injunction is discretionary and the Trial Court has exercised its discretion in a proper manner. Writ petition is, however, disposed of with a request to Trial Court to make endeavour to decide the suit within one year from the date of production of certified copy of this order.
