JUSTICE ANIL KUMAR UPMAN Order [2026:RJ-JP:21614-DB] (2 of 3) [CRLW-438/2026] 21/05/2026 These writ petitions are filed for quashing of the orders dated 03.02.2026 and 31.01.2026 respectively whereby, the applications filed by the petitioners for grant of 5th and 4th regular parole respectively, were dismissed. Learned counsel for the petitioners submits that the issue involved herein is no more res integra and stands resolved by an order of the Coordinate Bench of this Court dated 17.03.2026 passed in the case of Fazlur Rehman Sufi Alias Shamin & Ors. Vs. The State of Rajasthan & Ors.; D.B. Criminal Writ Petition No. 294/2026 whereby, the same/similar order qua the petitioners therein, was quashed and they were extended benefit of 5th parole for a period of 40 days. They pray for similar relief. Although, learned Additional Solicitor General of India for Rajasthan opposes the prayer; but, could not dispute that similarly situated persons were extended benefit of 40 days parole by a Coordinate Bench of this Court vide order dated 17.03.2026. In view thereof, these writ petitions are disposed of in following terms:- 1. The orders dated 03.02.2026 and 31.01.2026 are quashed and set aside. 2. The petitioner are extended benefit of 5th and 4th regular parole respectively for a period of 40 days from the date of their release subject to condition that each of them shall furnish a personal bond of ₹1,00,000/- and two sound and solvent sureties of ₹50,000/- each to the satisfaction of the Superintendent, Central Jail concerned who shall also be at liberty to impose such other just and [2026:RJ-JP:21614-DB] (3 of 3) [CRLW-438/2026] suitable conditions as prescribed.
