The petitioner is apprehending his arrest in connection with Barhi PS Case No.65 of 2012 corresponding to GR No.850 of 2012, for offence registered under section 414 of Indian Penal Code, Section 21 of the Mines and Minerals (Regulation and Development) Act and Section 33 of the Indian Forest Act, pending in court of learned Sub Divisional Judicial Magistrate, Hazaribagh. 3. Learned counsel for the petitioner submits that the petitioner happened to be owner of the truck and the allegations are made of over loading 3.8 tones of excess coal. He next submits that now the petitioner has already deposited the price of excess coal in the office of D.T.O., Hazaribagh (contained in Annexure-2). He then submits that the petitioner has earlier not moved before the High Court. 4. Learned State counsel opposes prayer and submits that 2026:JHHC:11690 2 A.B.A. No. 1822 of 2026 allegations are there of over loading excess coal as aforesaid on the said truck. 5. Considering that the petitioner is the owner and only allegation is made of over loading excess coal to the tune of 3.8 tons and by way of Annexure-2, the amount of excess coal loaded on the said truck has been deposited in the office of the D.T.O., Hazaribagh, and in that view of the matter, the petitioner, above named, is, hereby, directed to surrender before learned court within two weeks from today, and learned court shall release the petitioner, above named, on such terms and conditions as well as sureties as the learned court may deem fit and proper. 6.
