Chakraborty …for the petitioner Mr. P P Das Ms. Sana Naaz ..for the State Learned counsel appearing on behalf of the petitioner submits that only the material available against the petitioner is the statement of a co-accused, which is not admissible in evidence. Another co- accused arrested in connection with this case has been granted bail. He also submits that charge sheet has already been submitted. Learned counsel appearing on behalf of the State opposes the prayer for anticipatory bail. He submits that the contraband was recovered from the house of the petitioner. His wife was also arrested and subsequently granted bail. Considering the above and the other incriminating materials available in the case diary, I do not consider this is to be a fit case for granting anticipatory bail. Accordingly, the application for anticipatory bail of the petitioner is rejected. (Jay Sengupta, J.)
