Mr. Rachit Tiwari, Advocate, for the petitioner.
Mr. Sudhir Nailwal, Standing Counsel, for the State. (2) According to petitioner, he purchased a plot of land from one Sri Ashok Kumar by registered sale deed dated 14.3.2015 and his name was entered in the revenue record, however, during consolidation proceedings, petitioner was allotted a new Chak, but possession of that Chak has not been given to him. By means of this writ petition, petitioner has sought the following reliefs:
“i) Issue a writ, order or direction in the nature of mandamus, commanding/directing the Respondents to demarcate the co-tenureship land of petitioner Chak No. 27, new Khasra No. 614 admeasuring 0.2220 hectare situated in Village Asafnagar, Pargana and Tehsil Roorkee, District Haridwar in pursuance to order dated 29.04.2026 issued by Respondent No. 1 (Annexure No. 3, Page No. 15) as expeditious as possible, preferably within a stipulated period fixed by this Hon’ble Court and/or;
ii) Issue a writ, order or direction in the nature of mandamus, commanding/directing the Respondent Nos. 1 & 3 to decide pending application of petitioner dated 06.06.2026 for

2026:UHC:5220 demarcation of Chak No. 27, new Khasra No. 614 admeasuring 0.2220 hectare situated in Village Asafnagar, Pargana and Tehsil Roorkee, District Haridwar (Annexure No. 5, Page No. 18 to 19) within the stipulated period fixed by this Hon’ble Court.” (3) Learned State Counsel, on instructions, however submits that an appeal is reportedly pending against the
order passed by Consolidation Officer, whereby Chak was allotted to petitioner. He submits that without decision in that appeal, which is pending before Settlement Officer, Consolidation, it is not possible to hand over physical possession of the allotted Chak to petitioner. (4)
Learned Counsel for the petitioner submits that petitioner has moved an application before Assistant Collector/Sub Divisional Magistrate, Roorkee on 6.6.2026, therefore he be directed to take decision thereupon. Learned State Counsel submits that he has no objection if the writ petition is disposed of in terms of prayer made by petitioner’s Counsel. (5) Writ petition is, accordingly,
disposed of with a direction to Assistant Collector/Sub Divisional Magistrate concerned to take decision on petitioner’s application, as per law, within eight weeks from the date presentation of certified copy of this
order, provided the
order of Consolidation Officer, whereby Chak was allotted in favour of petitioner, has attained finality.
