Affidavit-of-service filed on behalf of the petitioner is taken on record. 2. Learned advocate representing the petitioner submits that a complaint was lodged with the concerned police station on 12th March, 2026 stating that some persons trespassed into the house of the petitioner and threatened him by using expletives. Petitioner prays for direction upon the concerned police authority to take steps which would restrain such persons to recur such incident in future. 3. Mr. Mitra, learned advocate representing the State respondents has filed one communication dated 30th March, 2026 of Officer-in-Charge, Junput Coastal Police Station, Purba Medinipur and same is taken on record. Copy of the said communication dated 30th March, 2026 is made over to the learned advocate representing the petitioner. [2] 4. It is disclosed in the said communication dated 30th March, 2026 that based on the complaint lodged by the petitioner a criminal prosecution being Junput Coastal P.S. Case No.40 of 2026 dated 24th March, 2026 under certain provisions of BNS was initiated. It is also stated that investigation is continuing. 5. During course of hearing, it is apprised that a title suit being T.S. No.105 of 2026 is pending before the Civil Court which was instituted by the petitioner. Therefore, it is found that there is civil dispute continuing between the petitioner and the defendants. 6. In view of initiation of aforesaid criminal prosecution by the concerned police authority, said proceeding shall be taken to its logical conclusion, in accordance with law, at an early date. 7. Writ petition stands disposed of. 8. However, this order shall not preclude the petitioner to approach the jurisdictional Magistrate, if occasion so arises in future. 9. Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings. (SAUGATA BHATTACHARYYA, J.)
