(2) Petitioner participated in a selection, however he was not selected and respondent no. 6 was recommended for selection. In this writ petition, petitioner has sought the following reliefs:-
“i) To, issue a writ, order or direction, in the nature of certiorari calling for the records and quash the selection list dated 27.08.2025, whereby respondent no. 6 (Ashish Kumar) has been declared selected on the post of Assistant Teacher (Hindi) Scheduled Caste category in Gurunanak Purv Madhyamik Vidyalay Khalimahuvat Khatima, District- Udham Singh Nagar. (Contained as Annexure No. 6 to the writ petition)
ii) To, issue a writ, order or direction, in the nature of mandamus commanding and directing the respondent authorities to consider the case of petitioner for the appointment on the post of Assistant Teacher (Hindi) Scheduled Caste category in Gurunanak Purv Madhyamik Vidyalay Khalimahuvat Khatima, District- Udham Singh Nagar.”

Learned Counsel for the petitioner submits that all members of the selection committee were under the influence of the Management, therefore they awarded more than 80 per cent marks in interview to respondent no. 6, while petitioner was awarded only 40 per cent marks by each member of the selection committee.
(4) Learned State Counsel, however, submits that subjective assessment made
2026:UHC:890 by the selection committee is beyond the pale of judicial review. He submits that the selection committee has to evaluate suitability of a candidate for the role, which would be assigned after his/her appointment.
(5) Be that as it may, since petitioner has raised issue of non-recording of reason for awarding more than 80 per cent marks to respondent no. 6 in the interview, therefore, writ petition is disposed of granting liberty to petitioner to make representation to District Education Officer concerned. If he makes representation within one week from today, decision thereupon shall be taken, as per law, within two weeks thereafter.
