02/ 29.04.2026: Heard learned counsel for the petitioners through Video Conferencing and learned counsel for the State.
2. The petitioners are apprehending their arrest in connection with Saraiyahat P.S. Case No. 156 of 2025, registered under sections 126(2), 352, 115(2), 118(1), 117, 351(2), 351(3), 109(1), 303(2), 324(4) and 3(5) of BNS, 2023, pending in the Court of learned Judicial Magistrate, Giridih.

Learned counsel for the petitioners appearing through Video Conferencing submits that there are case and counter case between the parties. He next submits that both sides have lodged the case and both sides have received injury and so far these petitioners are concerned, there are general and omnibus allegation of assault. He next submits that injury has been received by the husband of the informant by the assault made by one Sitaram Raut. On these grounds, he submits that the petitioners may kindly be provided privilege of anticipatory bail.

Learned counsel for the State opposes the prayer and submits that allegations of assault are there.

Looking into contents of F.I.R, it transpires that allegation of

assault is there against Sitaram Raut pursuant to that injury has been received by the husband of the informant. So far these petitioners are concerned, there are general and omnibus allegation of assault. There are case and counter case between the parties and altercation took place due to land dispute.

In the attending facts and circumstances of the case, I am inclined to grant anticipatory bail to the petitioners. Accordingly, the above named, petitioners are directed to surrender before the learned court within three weeks from today and in the event of their surrender / arrest, the petitioners shall be released on bail, on furnishing bail bonds of Rs. 25,000/- (twenty five thousand) each with two sureties of the like amount each, to the satisfaction of learned S.D.J.M, Giridih, in connection with Saraiyahat P.S. Case No. 156 of 2025, subject to conditions as laid down under Section 482 (2) of B.N.S.S, 2023.
