Present writ petition is instituted, inter alia, praying for direction upon the concerned respondent authorities for providing security to the petitioner on deployment of police personnel. 2. Learned advocate representing the petitioner submits that petitioner is a Coordinator and National Executive Committee Member of Republican Party of India (Athawale). It is also contended that previously “Z+” security was provided to the petitioner by the State Agencies but such facility was withdrawn in phased manner. On being aggrieved by withdrawal of security which was provided by the State Agencies petitioner prays for direction upon the concerned respondent authorities to provide security on deploying police personnel. 2 3. Prayer is made that either State Agencies or Central Agencies may be directed to provide such facility to the petitioner. 4. Today, during course of hearing a communication dated 27th March, 2026 of Deputy Inspector General of Police (Legal) West Bengal is placed before this Court and same is taken on record. It is disclosed in the said communication dated 27th March, 2026 that petitioner is not a categorized protectee and is not “Z+” category protectee. It is also stated in the said communication dated 27th March, 2026 in reference to memo dated 18th September, 2025 of Superintendent of Police (DIB) Baruipur Police District that no element was found available in the police record which substantiates threat to petitioner’s life and properties nor anything revealed in course of physical enquiry that leads to a conclusion to the extent any kind of threat perception exists against the petitioner. 5. During course of hearing learned advocate representing the petitioner has relied upon an order dated 19th January, 2026 passed by a coordinate bench on another writ petition being WPA 313 of 2026 (Humayun Kabir Vs. State of West Bengal & Ors.) wherein direction was given upon the concerned 3 authority of Ministry of Home Affairs to take decision for providing security to the petitioner in that writ petition on consideration of representation. 6. Union of India is represented by learned advocate who has prayed for accommodation. 7. Having considered the order passed by a coordinate bench on a similar issue in Humayun Kabir (supra) Court finds no purpose would be sub-served in keeping this writ petition pending. 8. Court grants leave to the petitioner to file a composite representation to the Secretary, Ministry of Home Affairs, Union of India being respondent no. 1 seeking to provide security on deploying police personnel by fortnight from date. 9. If such representation is made within the aforesaid time Secretary, Ministry of Home Affairs being respondent no. 1 is directed to decide the same in accordance with law by 4 (four) weeks thereafter and decision to be communicated to the petitioner by fortnight thereafter. 10. It is made clear that all points are kept open. 11. Since no affidavits are called for allegations contained in the writ petition are deemed not to have been admitted. 4 12. With the aforesaid directions writ petition stands disposed of. 13. Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings. 14. .
