Bazar Police Station Case No. 345 of 2024 dated 04.12.2024 u/s 103/3(5) of the BNS. -And- In the matter of : Jatan Soren & Anr. … Petitioner(s) Mr. Sourav Mondal Ms. Moumita Kumar Mr. Rony Mondal … for the Petitioner(s) Mr. Ranadeb Sengupta Ms. Debjani Sahoo … for the State-respondent(s) Learned advocate for the petitioner submits that the petitioners are in custody for one year three months. It is contended that the petitioners were under the impression that the deceased was a thief as such they assaulted him. However, there was neither any previous animosity and/or preparation for which the offence has been committed nor there was any conspiracy. Learned advocate for the State opposes the prayer for bail and submits that the deceased was mercilessly assaulted at the behest of the present petitioners and others. There was eyewitness to the incident also. 2 Be that as it may, having considered the genesis of the present case, I am of the opinion that further detention of the present petitioners is unwarranted. Hence, the prayer for bail of the petitioners is Allowed. Accordingly, the petitioner viz, Jatan Soren and Mahesh Soren shall be released on bail upon furnishing bond of Rs.20,000/-(Rupees Twenty Thousand only) each, with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the learned Additional District and Sessions Judge, 1st Court, Suri, Birbhum. If on bail, the petitioners shall also make themselves physically available on each and every date so fixed by the learned trial court and shall not leave the district of Birbhum without prior intimation to the learned trial court. Accordingly, CRM(M) 663 of 2026 is allowed. Pending application(s), if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta.
