P.P. …...... 03/25.02.2026: This bail application has been filed under Sections 483 & 484 of BNSS, 2023 wherein, prayer has been made for grant of bail as he is in custody for allegedly committing offence punishable under Sections 309(4) of the Bharatiya Nyaya Sanhita and Sections 27 of the Arms Act. 2. Heard, learned counsel for the petitioner learned counsel for the State and have also gone through the impugned order. 3. Learned Spl. P.P. opposes the prayer for bail. 4. This is a case of dacoity in the shop of the goldsmith. Though the petitioner is not named in the F.I.R, but from the possession of the petitioner, gold ornament with the tag of the shop from where the materials were looted where recovered. The case of other co-accused persons stands on a different footing. 5. Considering the aforesaid fact, since there is recovery, I am not inclined to grant privilege of bail to the petitioner. Accordingly, the prayer for bail of the petitioner in connection with Chas P.S. Case No.99 of 2025, corresponding to Session Trial Case No.320 of 2025, pending in the Court of learned Additional Sessions Judge-III, Bokaro stands rejected.
