Hon’ble Manoj Kumar Tiwari, J. Mr. Faizan Ali, Advocate holding brief of Mohd. Safdar, Advocate for the petitioner. Mr. V.D. Bisen, Additional CSC for the State.
2. By means of this writ petition, petitioner has sought the following reliefs:
“i) Issue a writ order or direction in the nature of Mandamus commanding and directing the respondent authorities to remove the illegal encroachment from Chak Road Khasra No.225 of village Govindpur Wajidpur, Tehsil Roorkee, District Haridwar.
ii) Issue a writ order or direction in the nature of Mandamus commanding and directing the respondent authorities to decide the pending representation of petitioner.”
3. Petitioner relies upon order passed by Tehsildar/Assistant Collector, Roorkee dated 30.04.2019 for contending that respondent Nos. 4 and 5 have encroached upon the chak road.

4. Learned State counsel submits that instead of approaching this Court, petitioner should have moved a proper application before Assistant Collector concerned.
5. The writ petition is, accordingly,
disposed of with liberty to petitioner to move appropriate application before the Assistant Collector.
6. If he makes application within two weeks from today, decision thereupon shall be taken, as per law, within eight weeks thereafter but only after hearing respondent Nos. 4 and 5.
7. The Assistant Collector shall also enquire as to whether petitioner has encroached upon any part of public land/water body land and if he is found encroaching upon such land, then report to that effect shall be submitted by Assistant Collector to the District Magistrate for necessary action.
