Before the trial Court, the petitioner filed an application under Order XI Rule 1 CPC seeking interrogatories. The said petition was taken up for final hearing. On the said day, the respondent did not appear, but the petitioner was present. The learned trial Judge, on considering the averments made in the affidavit, found that the interrogatories were sought with reference to the affidavit relating to assets and liabilities filed in I.A.No.3 of 2020 in O.P.No.3685 of 2018, but the said I.A. had already been disposed of on 29.04.2024. Since the application in which the affidavit was filed had already been disposed of, the interrogatories sought by the petitioner were held to be not maintainable, and the petition was dismissed. Aggrieved by the same, the present revision has been filed. 3. The learned counsel for the revision petitioner submitted that the petitioner sought interrogatories with regard to the affidavit filed by the respondent relating to assets and liabilities in I.A.No.3 of 2020. However, since I.A.No.3 of 2020 had already been disposed of, the prayer sought by the https://www.mhc.tn.gov.in/judis https://www.mhc.tn.gov.in/judis CRP No. 1407 of 2026 petitioner was not maintainable, and the order passed by the learned trial Judge is justifiable and requires no interference. 4. It is also seen that the petitioner had approached the Court in the year 2018 seeking declaration that the marriage is null and void. As on date, both parties have not been cooperating for early disposal of the trial. If any defence is available to the petitioner regarding the assets and liabilities of the respondent, he is at liberty to put forth the same during the course of trial. The learned trial Judge is directed to dispose of the case within a period of four months. 5. In view of the above, this Civil Revision Petition is dismissed. Consequently, connected miscellaneous petition is closed.
