The petitioner is an accused in a case registered for the offence punishable under Sections 103(1), 140(1), 61(2), 238 & 3(5) of the Bharatiya Nagarik Suraksha Sanhita, 2023 and Section 17(1)(2) of the C.L.A. Act. 3. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case and has not committed any offence as alleged. The petitioner has not been named in the FIR. He has been implicated in this case on the basis of his alleged confessional statement as well as the confessional statement of co-accused Rohit Kumar Sahu. Except that, there is no other material to connect the petitioner with the alleged offence. It is further submitted that co-accused Dipak Kumar @ Chhotu and Rohit Kumar Sahu with similar allegations have already been granted regular bail by different Benches of this Court vide orders dated 02.05.2025 & 04.09.2025 passed in B.A. Nos. 3409/2025 & 6863/2025 respectively. Though one more criminal case is pending against the petitioner, however, so far as the present one is concerned, he has been implicated in this case without any cogent material. The petitioner is in judicial custody in connection with the present case since 08.02.2025. Hence, he may be given the privilege of regular bail. 4. Learned A.P.P opposes the petitioner’s prayer for bail. 5. Considering the aforesaid facts and circumstances of the case, I am inclined to enlarge the petitioner on bail. Accordingly, the above named 2026:JHHC:12757 petitioner is directed to be released on bail on furnishing bail-bond of Rs.20,000/- (twenty thousand only) with two sureties of the like amount each to the satisfaction of Sri Randhir Kumar Singh, learned Additional Sessions Judge- III, Chatra in connection with S.T.
