According to petitioner, respondent no. 5 has made encroachment upon a pathway by planting trees and putting boulders, which is causing inconvenience to residents of Village Kotla Kalyanpur and Village Kadwal Gaon Dhalani, Sahaspur, Dehradun. 4. By means of this writ petition, petitioner has sought a direction to the authorities to get the encroachment made by respondent no. 5 removed. Petitioner further apprehends that some nefarious activities are being carried out in respondent no. 5 institute. 5. Learned State Counsel submits that if petitioner has any grievance, then he can make representation to Sub Divisional Magistrate concerned. 6. Learned counsel for petitioner submits that petitioner has made representation to Sub Divisional UKHC010100822026 2026:UHC:5364 Magistrate, Vikasnagar, however, he may be permitted to make fresh representation. 7. The writ petition is, accordingly, disposed of with liberty to petitioner to make representation. If he makes representation within ten days from today, Sub Divisional Magistrate concerned shall take decision thereupon, as per law, within six weeks thereafter. It goes without saying that representative of respondent no. 5 shall also be given opportunity of hearing in the matter.
