01.
1. Heard.
2. The petitioner is seeking pre-arrest bail in connection with Kamakhyanagar P.S. Case No.476 of 2025 corresponding to G.R. Case No.927 of 2025 registered on the allegation of the commission of offences under Sections 303(2)/3(5) of B.N.S., 2023 pending in the Court of the learned S.D.J.M., Kamakhyanagar.
3.
Learned counsel for the petitioner, on instruction from the petitioner, submits that, except the present bail application, no other bail application of the petitioner is pending in any other Court relating to the aforesaid F.I.R. p. 2
4. The prosecution case, in brief, is that one Babuli Senapati lodged an FIR before the I.I.C., Kamakhyanagar Police Station, inter alia alleging that on 17.09.2025, in the morning, a lineman of his section informed him that villagers of Balisahi had apprehended three persons while they were attempting to cut electric wires. Thereafter, he, along with other staff, reached the spot and found two bundles of AAC conductors, which were seized from the apprehended persons. Hence, this case.
5.
Learned counsel for the petitioner submits that the present petitioner has been implicated in the case solely on the basis of the confession of a co-accused. He further submits that the accused persons from whom the stolen electric conductors were recovered had been arrested and were subsequently released on bail.
6. Regard being had to the submission made by the learned counsel for the petitioner and the nature of allegation, I am inclined to grant the petitioner on p. 3 anticipatory bail. Accordingly, it is directed that in the event the petitioner is arrested, he shall be released by the Arresting Officer, subject to the conditions that the petitioner shall not involve in any other similar cases; he shall cooperate with the investigation and shall appear before the I.O. as and when his presence are required for the purpose of investigation. Violation of any of the conditions shall entail cancellation of bail.
7. With this observation, the ABLAPL is disposed of.
