GP FOR HOME 3 THE HONOURABLE SRI JUSTICE MAHESWARA RAO KUNCHEAM WRIT PETITION NO: 22075 of 2026 The Court made the following Order: Instant Writ Petition has been filed under Article 226 of the Constitution of India by the petitioners for the following relief: “to issue a writ of mandamus or any other appropriate writ or direction declaring the action of the respondents Nos.1 and 2 are not granting permission to conduct One day hunger Strike, as illegal and violative of Article 19, 14 of Indian Constitution and further directing the respondents No.1 and 2 to grant permission for conducting one day hunger Strike at SC Colony Garagaparru Villaga, Palakoderu Mandal of West Godavari District, in the interest of Justice” 2. Learned counsel for the petitioners submits that petitioners are agriculturists and are residents of Garagaparru Village, Palakoderu Mandal, West Godavari District. According to the counsel, the main grievance of the petitioners is that the petitioners along with other persons, preferred a representation dated 10.07.2026 before the Superintendent of Police, Bhimavaram, seeking permission to conduct a peaceful procession namely “one day hunger strike” at SC Colony, Garagaparru Village, Palakoderu Mandal, West Godavari so as to espouse rights of concerned persons. 3. Learned counsel further draws the attention of this Court to Ex.P6–i.e., petitioners’ representation dated 10.07.2026 and submits that despite the petitioners made a representation to the concerned police authorities on 10.07.2026 itself, respondent police authorities are not acting upon the same, which leads to multifarious problems and also violation of fundamental rights of the petitioners. 4 4. On the other hand, learned Assistant Government Pleader for Home basing on the written instructions submits that police have received representation from the petitioners. However, the same is not processed due to the law and order issues. He further states that the police authorities are contemplating to pass orders in accordance with law, basing on ground realities. 5. Having regard to facts and circumstances and taking into consideration the submissions made by learned counsel for petitioners as well as learned Assistant Government Pleader for Home, the present Writ Petition is disposed of directing the 1st respondent to dispose of the petitioners’ representation dated 10.07.2026, within a period of ten (10) days from the date of receipt of a copy of this order and communicate the same to the petitioners through registered post with acknowledgment due.
