O R D E R By consent, the writ petition is taken up for final disposal at the admission stage itself. 2.The petitioner has filed this writ petition seeking issuance of Writ of Mandamus directing the first respondent to modify the order dated 03.12.2025 and thereby granting permission to the petitioner to use minimum power explosive materials from the explosive licence holder and blast the same through trained foremen, to remove the hillocks and boulders situated in petitioner property situated at S.F.No.93/C4A in No.10, Muthur Village, Kinathukadavu Taluk, 2/6 https://www.mhc.tn.gov.in/judis
W.P.No.7326 of 2026 Coimbatore District, based on the petitioner’s representation dated 31.12.2025 within a time frame fixed by this Court. 3.The learned counsel appearing for the petitioner submitted that the petitioner is the owner of the agricultural land to an extent of 5.29 acres situated at S.F.No.93/C4A, No.10, Muthur Village, Kinathukadavu Taluk, Coimbatore District. On 22.02.1992, the petitioner entered into an agreement with the Government of Tamil Nadu represented by the first respondent for quarrying and carrying away minor minerals and in lieu of the said agreement, the first respondent allowed the petitioner to commence mining operations for stones in the said land for a term of three years.
4.The learned counsel appearing for the petitioner further submitted that after the licence period, the petitioner want to restore the quarry land into agricultural land, thereby, the petitioner made representation to the respondents seeking to grant permission to the petitioner to use minimum power explosive materials from the explosive licence holder and blast the same through trained foremen, to remove the hillocks and boulders situated in petitioner property and since the same was not considered, the petitioner filed W.P.No.30079 3/6 https://www.mhc.tn.gov.in/judis
W.P.No.7326 of 2026 of 2025 and pursuant to the order of this Court dated 11.10.2025 made in the said writ petition, the first respondent vide order dated 03.12.2025 granted permission to blast the hillocks in the subject property by using eco friendly, non explosive, no vibration rock crack power (Expensive Mortar) within a period of 30 days from 08.12.2025 to 06.01.2026. However, the petitioner was not able to complete the same within 30 days and hence, the petitioner made representation to the first respondent on 31.12.2025 and 03.01.2026 seeking to modify the order passed by the first respondent on 03.12.2025, however, the same has not yet been considered. 5.The learned counsel appearing for the petitioner further submitted that this Court may without going into the merits of the case, issue direction to the first respondent to consider the petitioner's representations dated 31.12.2025 and 03.01.2026 and to pass appropriate orders, within a reasonable time frame. 6.The learned Additional Government Pleader appearing for the respondents submitted that the petitioner’s representations dated 31.12.2025 and 03.01.2026 will be considered on merits and in 4/6 https://www.mhc.tn.gov.in/judis
W.P.No.7326 of 2026 accordance with law and appropriate orders will be passed, within a reasonable time frame.
7.Considering the limited relief now sought for by the learned counsel appearing for the petitioner, this Court, without expressing any opinion on the merits of the case, directs the first respondent to consider the petitioner's representations dated 31.12.2025 and 03.01.2026, on merits and in accordance with law and to pass appropriate orders, within a period of six weeks from the date of receipt of a copy of this order. 8.The writ petition is disposed of.
