By means of this writ petition, petitioner has sought the following relief: “Issue a writ order or direction in the nature of mandamus commanding the respondents to execute the order dt. 16.07.2022 passed by Respondent No. 1 allowing the application u/s 14 of the SARFAESI Act filed by the petitioner annexed as (Annexure No. 4) Pg. No 39 and complete the task of handing over the physical possession of the property in question to the petitioner financial institution with the assistance of the respondent no. 2 expeditiously within the shortest period prescribed by the Hon'ble Court.” 3. Petitioner relies upon order passed by District Magistrate, Nainital on 16.07.2022 in proceedings under Section 14 of SARFAESI Act. 4. Learned State Counsel submits that if petitioner makes representation to the SSP concerned, decision thereupon shall be taken. 6. The writ petition is, accordingly, disposed of by permitting petitioner to make representation. If petitioner makes representation to SSP concerned within three weeks from today, decision thereupon shall be taken, as per law, within three months thereafter.
