2 petitioner. Also heard Mr. Nitansh Kumar Jaiswal, learned Deputy Government Advocate, appearing for the State/respondent No. 1. 2. The present petition has been filed by the petitioner with the following prayer:
“It is, therefore, prayed that this Hon’ble Court may kindly be pleased to quash and set aside the impugned order taking cognizance dated 01.12.2025 (Annexure P/1), charge-sheet No. 63 of 2025 dated 07.03.2023 along with FIR No. 210 of 2019 dated 13.07.2019 (Annexure P/2), and the entire criminal case No. 6679 of 2025 including consequential proceedings against the petitioner for alleged commission of offence under Section 420, 409 and 34 of the Indian Penal Code, 1860, pending before learned Judicial Magistrate First Class, Bemetara (C.G.).”

Learned Senior Advocate for the petitioner submits that although the present CRMP has been filed for quashing of the FIR, the charge- sheet dated 07.03.2023, and the entire criminal proceeding, in the present case the charges have already been framed by the learned trial Court against the petitioner. Therefore, he prays that the present petition be dismissed as withdrawn with liberty to challenge the same before the appropriate forum. 4. Prayer is allowed. 3
5. In view of the submission made by the learned Senior Advocate for the petitioner, the present petition is dismissed as withdrawn with liberty to the petitioner to take recourse to law before the appropriate forum, if so advised. 6.
