HIGH COURT OF UTTARAKHAND AT NAINITAL Writ Petition Service Single No.1666 of 2026 06 July, 2026 Sashi Bardhan Adhikhari --Petitioner Versus State Of Uttarakhand and Others --Respondents ---------------------------------------------------------------------- Presence:- Mr. Sandeep Tiwari and Mr. Piyush Tiwari, learned counsel for petitioners. Mr. G.S. Negi, learned Additional C.S.C. with Mr. Bhupendra Singh Koranga, learned Brief Holder for the State of Uttarakhand/respondents. Hon’ble Pankaj Purohit, J. (Oral)
Petitioner in substance has challenged the impugned order dated 02.03.2026 passed by respondent No.3, whereby, petitioner was repatriated to his parent department i.e. Forest Department, as well as the relieving order dated 07.03.2026 passed by respondent No.4. 2. Petitioner is a Forester in Forest Department. He was sent on deputation to the Watershed Management Department vide order dated 27.09.2023. Vide impugned order dated 02.03.2026, said deputation was put to an end keeping in view the fact that petitioner is scheduled to be retired within 03 years from the date of passing of the order. 3. Petitioner filed the present writ petition mainly on the ground that his daughter is 77% mentally disabled and his mother has already passed away and there is petitioner and the stepmother to look after his daughter. For the said reason, petitioner wants this Court to interfere in the matter. UKHC010111542026

4. Be that as it may. The deputationist has no indefeasible right in the department where he has been placed on deputation. Purely on the humanitarian ground, this Court is inclined to interfere in the matter by permitting him to make a fresh representation to respondent No.3, which respondent No.3 shall decide sympathetically within a stipulated period. 5. To the said relief, there is no opposition from the side of learned State Counsel. 6. Accordingly, the writ petition is finally disposed of, permitting petitioner to file a fresh representation to respondent No.3 ventilating his entire grievances and the reasons for his continuous deputation in the Watershed Management Department, within a week from today. If such representation is submitted by petitioner within a week before respondent No.3, respondent No.3 shall pass a reasoned and speaking order, keeping in view the disability of petitioner’s daughter, within a week thereafter. Till the representation is decided by respondent No.3, petitioner shall not be compelled to join in his parent department pursuant to relieving order dated 07.03.2026 passed by respondent No.4. 7. Pending application(s), if any, stands disposed of.
