1. Affidavit-of-compliance filed by the respondent- Howrah Municipal Corporation is taken on record.

This Court vide order dated 20.05.2025 had directed the Corporation to decide petitioner’s representation dated 01.08.2024 within a period of eight weeks from the date of communication of that order. The said representation has been decided and the department has issued a demolition notice for unauthorized construction in respect of premises no. 144/31, Dharmatala Road under Ward No.6, Howrah. The demolition notice indicates that there has been unauthorized and illegal construction entirely on the fourth and fifth floors as well as deviation from the sanctioned building plan of G+3 floors. Though the notice does not indicate the actual deviation.

Learned Counsel for the respondent states that the notice which has been issued to the offender who has carried out the unauthorized construction would indicate the nature of the deviation and the unauthorized construction in the said building.
4. It is directed that the Corporation shall act in accordance with the notice which has been issued and shall carry out the necessary demolition in accordance with law as expeditiously as possible.

Learned Counsel for the petitioner submits that the petitioner is satisfied with the compliance report.
6. In view of the above, nothing survives in the present contempt application.
7. With the above direction, the contempt application is
disposed of and the contempt proceeding is dropped.
