The petitioner has filed this writ petition seeking following reliefs:- “10.1 That, this Hon'ble Court may kindly be pleased to notices to the respondents returnable within early date of hearing. 2 10.2 This Hon’ble Court may kindly be pleased to direct the Respondents No. 2 & 3 to fix the family pension on favour of the petitioner within stipulated period. 10.3 That this Hon’ble court may kindly be pleased to direct the Respondents No. 2 & 3 to consider and decide the representation moved by the petitioner in accordance with law within stipulated period. 10.4 That, this Hon’ble Court may kindly be pleased to grant any other relief(s)/order(s)/direction(s) in favour of the petitioner, which deemed fit and proper in the facts and circumstances of the case, in the interest of justice. 10.5 Cost of the petition” 2. Learned counsel for the petitioner submits that the petitioner is not being paid the death-cum-retiral dues after the death of her husband against which, petitioner has also submitted representation dated 25.05.2022 (Annexure P/2) which till date is not considered and decided and therefore, direction be issued to the concerned authority to consider and take decision on the representation at the earliest within specified time. 3. On the other hand, learned counsel for the Respondents/State would submit that as petitioner is not pressing this writ petition on merits, he is having no objection to the limited prayer. He however, submits that the representation is of more than 3 ½ years. 4. I have heard learned counsel for the parties and perused the documents placed on record. 5. On due consideration of the submission of counsel for the respective parties, facts and circumstances of the case, nature of grievance raised by the petitioner, this writ petition at this stage is disposed of permitting the petitioner to submit fresh comprehensive representation before the Respondents No. 2 & 3 with all supporting documents and if such a representation is submitted by the petitioner, concerned authority shall consider and take decision on the representation to be submitted by the petitioner in accordance with law, expeditiously, preferably within a period 3 of 04 months from the date of receipt of representation after giving opportunity of hearing of the Respondent No. 4 herein also. 6.
