Let affidavit-of-service, as filed in Court, be kept on record. 2. In spite of service, none appears on behalf of the school authorities. 3. The petitioner‟s application for transfer on the distance ground as well as medical ground was rejected by the concerned D.I., sometime in the year, 2022 on the ground that the petitioner did not fall within the 10% cap as provided in the notification. As it now transpires that due to the changed circumstances, this ground is no longer available for rejection as the school has zero students in its roll. 2 4. Thus, the petitioner is directed to make a fresh application for transfer by April 30, 2026 to the school authorities, which shall be forwarded by the school authorities with requisite „NOC‟ to the concerned D.I. by May 20, 2026. 5. Concerned D.I. will consider the application of the petitioner by June 15, 2026. 6. “Utsashree Portal” will not be an impediment for the authorities to take steps to consider the application of the petitioner. Application shall be made in an offline mode. 7. With the aforestated directions, the writ petition is, thus, disposed of. 8. There shall, however, be no order as to costs. 9.Urgent photostat certified copy of this order, if applied for, be supplied to the parties on usual undertaking. (Reetobroto Kumar Mitra, J.)
