Petitioner is hit by the condition mentioned in the regulations framed by Indian Nursing Council, which requires that minimum distance between two Nursing Colleges should be 5 kilometers. 6. Petitioner applied for Essentiality Certificate to the State Government; according to petitioner, State Government wrote to the Indian Nursing Council to relax the condition of minimum 5 kilometers distance between two Nursing Colleges and Uttarakhand Nurses and Midwives Council also made similar request to the Indian Nursing Council. The decision is said to be UKHC010113392026 2026:UHC:5389 pending before the Indian Nursing Council. 7. The reliefs sought in the writ petition are as follows:- “(i) Issue a writ, order, or direction in the nature of Mandamus directing Respondent No. 1 and 2 to grant essentiality certificate to the Maya Devi University for running B.Sc Nursing course (60 seats) for the academic year 2025- 26. (ii) Issue a writ, order, or direction in the nature of Mandamus commanding the Respondents, particularly Respondent No. 2 to decide the representation dated 16.06.2026 (Contained as Annexure No.-10 Page No.57-69) of the University for granting essentiality certificate to Maya Devi University for running B.Sc Nursing course (60 seats) keeping in mind that the other college/university offering B.Sc Nursing course is at more than 5kms of distance from the University. (iii) Issue a writ, order, or direction in the nature of Mandamus commanding the Respondent No. 3 to constitute examination board for conducting the semester examination of students undergoing B.Sc. Nursing Course for the academic year 2025-26.” 8. Having regard to the facts of the case, the writ petition is disposed of with liberty to petitioner to make representation to the Indian Nursing Council. If he makes representation within three days from today, decision thereupon shall be taken by Council, as per law, within four weeks from the date of presentation of certified copy of this order. 9.
