JUSTICE PARTHIVJYOTI SAIKIA ORDER 08.06.2026 Heard Mr. M Hoque, learned counsel appearing for the petitioner. Also heard Mr. K K Porasor, learned Additional Public Prosecutor, Assam and Ms. G. Chutia, learned counsel representing the respondent no. 2. By this application filed under Section 482 of the BNSS, 2023 the petitioner, namely, Sadir Hussain @ Md. Sadir Ali has prayed for pre-arrest bail in connection with Dalgaon P.S. Case No. 37/2026. In the FIR dated 02.03.2026, it has been alleged that the petitioner rapped a 13 (thirteen) year old girl while she was sleeping inside her house. In her statement recorded under Section 183 of the BNS, 2023 the victim girl has supported the allegations made against the present petitioner. Considering entire aspect of the matter, this Court is of the opinion that the petitioner does not deserve to be given the privilege of pre-arrest bail. Hence, the prayer for pre-arrest bail of the petitioner is rejected. Accordingly, the present bail application is dismissed and disposed of. Case Dairy shall be returned. JUDGE Comparing Assistant
