The petitioner is an accused for the offences punishable under Section 414/34 of the Indian Penal Code and Section 30(ii) of the Coal Mines Act. 3. Learned counsel for the petitioner submits that the petitioner’s bail application was earlier rejected by a Bench of this Court vide order dated 17.11.2025 passed in B.A. No. 9918 of 2025. By way of present application, the petitioner has renewed his prayer for regular bail primarily due to the reason that he has been in judicial custody in connection with the present case since 11.09.2025. The petitioner is the owner of the truck bearing registration No. JH 02BK-8131 from which there is alleged recovery of 30 tons of illegal coal. It is also submitted that charge against the petitioner has already been framed. Though the petitioner has criminal antecedent, however, considering the length of judicial custody, he may be given the privilege of regular bail. 4. Learned A.P.P. opposes the petitioner’s prayer for bail. 5. Having heard learned counsel for the parties and considering that the petitioner has been in judicial custody in connection with the present case since 11.09.2025 and that the charge against him has already been framed, I am inclined to enlarge the petitioner on bail. Accordingly, the petitioner above named is directed to be released on bail 2026:JHHC:12701 2 on furnishing bail bond of Rs.20,000/- (Rupees Twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Bermo at Tenughat (Bokaro) in connection with Gomia P.S.
