3. Punjab National Bank filed Original Application against respondent no. 3 before Debts Recovery Tribunal, Dehradun in proceedings under Section 19 of Recovery of Debts and Bankruptcy Act, 1993. The Tribunal allowed the Original Application filed by the bank vide judgment dated 30.08.2019. Petitioner has challenged the said judgment in this writ petition.
4. It is contended that petitioner was not party to the Original Application filed by the bank and the property purchased by him has been sold out in a public auction.
5. Learned counsel for the bank submits that property purchased by petitioner was mortgaged with the bank to secure a loan obtained by respondent no.

6. Since petitioner has statutory remedy under Section 20 of Recovery of Debts and Bankruptcy Act, 1993, therefore, this Court is not inclined to entertain this writ petition.
7. However, the writ petition is disposed of with liberty to petitioner to approach the Debts Recovery Tribunal under Section 20 of the aforesaid Act.
