31.03.2026 Serial no. 109 [G.S.D] CRM (M) 593 of 2026 In re : An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/under Section 483 of the BNSS, 2023 in connection with GR Case no. 1358 of 2025 arising out of Katwa Police Station Case No. 523 of 2025 dated 03.07.2025 u/s 126(2)/115(2)/70(1) of the BNS, 2023. -And- In the matter of : Dulal Sk. … Petitioner(s) Mr. Saswata Gopal Mukherjee, Sr Adv. Ms. Debadrita Mondal Ms. Sudeshna Chanda … for the Petitioner(s) Mr. Subhasree Patel Mr. Sobhan Gani … for the State-respondent(s) Learned advocate for the petitioner submits that so far as the accusations against the present petitioner is concerned, the same is without any foundation and neither the FIR nor the subsequent statement made by the victim do inspire any confidence. It is also alleged that the victim is an accused in NDPS case at Kerala, as such, there is no scope of the trial commencing in the near future. Learned advocate, as such, prays that the petitioner may be enlarged on bail. Learned advocate for the State has produced the case diary and opposes the prayer for bail. I have taken into account the letter of complaint which has the genesis of the case as well as the statement under section 183 of the BNSS. 2 Having considered that the petitioner has been specifically named and there is no change of circumstances since last rejection on 16.12.2025, I am not inclined to enlarge the petitioner on bail. Hence, the prayer for bail of the petitioner is Rejected. Accordingly, CRM(M) 593 of 2026 is dismissed. Pending application(s), if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities. (Tirthankar Ghosh, J.)
