The petitioner is an accused in the case registered for the offences punishable under Sections 126(2), 115(2), 117(2), 109(1), 303(2), 74, 79, 332(c), 351(2), 352 & 3(5) of the Bharatiya Nyaya Sanhita (BNS), 2023 and Section 3/4 of Prevention of Witch (Daain) Practices Act. 2. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and has not committed any offence as alleged in the F.I.R. Though the petitioner’s name has been mentioned at serial No. 9 of the F.I.R., however, on perusal of the written report, it would be evident that there is no allegation of any overtact against him. Several co-accused persons, namely, Kalava Devi @ Kalwa Devi, Muni Devi @ Munni Devi, Hemant Kumar, Suraj Kumar, Poonam Devi @ Punam Devi, Vipin Yadav @ Vipin Prasad Yadav, Mithlesh Kumar Yadav, Ravi Prasad Yadav, Sonu Kumar, Shanti Devi, Sankesh Kumar & Sourabh Kumar have already been granted anticipatory bail by a Bench of this Court vide 2026:JHHC:12697 2 order dated 08.12.2025 passed in A.B.A. No. 6895 of 2025. The petitioner is in judicial custody since 08.03.2026. Hence, he may be given the privilege of regular bail. 3. Learned A.P.P. opposes the petitioner’s prayer for regular bail. 4. Having heard learned counsel for the parties and considering the materials available on record, I am inclined to enlarge the petitioner on bail. The petitioner is directed to be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Koderma in connection with Satgawan P.S.
