02/ 22.04.2026: Heard learned counsel for the petitioner and learned counsel for the State.
2. The petitioner is apprehending his arrest in connection with Jamtara P.S. Case No. 70/2022 registered under sections 406, 420, 500/34 of I.P.C, pending in the Court of learned Chief Judicial Magistrate, Jamtara.

Learned counsel for the petitioner submits that petitioner is having show-room of tractor and three persons have taken loan for purchasing the three separate tractors for that finance has been made by Sriram Finance Company Pvt. Limited and for that formality signature has been taken by the petitioner. He next submits that apart from that there is nothing against the petitioner and the case is civil in nature. He submits that petitioner is not named in F.I.R and he has complied notice under section 41-A Cr.P.C. On these grounds, he submits that the petitioner may kindly be provided privilege of anticipatory bail.

Learned counsel for the State opposes the prayer and submits that allegations are there of taking signature of three persons on the paper for taking loan.

Considering that only allegations are there against the petitioner of taking signature of three persons on the paper for taking loan. The petitioner is not named in F.I.R and he has complied notice under section 41-
( 2026:JHHC:11728 ) A Cr.P.C and in that view of the matter, petitioner is directed to surrender before the learned court within two weeks from today and the learned court shall release the petitioner on terms and conditions and sureties as learned court deems fit and proper.
6. This anticipatory bail application is disposed of.
