The petitioner, above-named who is in custody in connection with Rail [Hatia] P.S. Case No.05 / 2023 [NDPS Case No.27 /2023 (S)] for the offence registered under Sections 20(b)(ii)(B) of the NDPS Act has moved for regular bail. It is submitted by the learned counsel on behalf of petitioner that nothing has been seized from the petitioner. He is not named in the FIR and it is alleged that 13 Kg. was seized from the co-accused persons who have been granted bail by the Co-ordinate Bench of this Court. It is further submitted that the only material against him is confessional statement of the co-accused persons which has got no evidentiary value. Petitioner has no criminal antecedent. Learned A.P.P. opposed the prayer for bail. Under the circumstances, the above-named petitioner is directed to be released on bail on furnishing bail bond of Rs.25,000/-(Twenty- Five Thousand) with two sureties of the like amount each to the satisfaction of the Court below.
