Ms. Gunjan Kanwal, learned counsel for the respondent. 4. The instant petition has been preferred under section 528 of BNSS, 2023, by the present applicant Smt. Shanti Devi for quashing of proceeding of Criminal Case No. 58 of 2025 ‘State of Shanti Devi’ pending in the court of learned Judicial Magistrate, Bhikiyasen, District Almora, arising out of First Information Report dated 07.06.2025 bearing FIR No. 0020 of 2025. 5. In this proceeding the present applicant has been summoned to face the trial for the offences punishable under sections 115(2) and 352 of BNS, 2023. The petition has been filed along with the compounding application with the affidavit of the present applicant and the respondent no. 2 and both are present and are identified by their respective counsel. 6. It is argued by the learned counsel for the parties that the applicant and the respondent/complainant settled their dispute and want to close this proceeding. It is also submitted that both the offences in which the applicant has been summoned are compoundable. 7. The respondent/complainant, who is present in court, submits that since now he has settled the dispute with the present applicant and, as such, he does not want to proceed with the impugned proceeding, therefore, the same be closed. 8. On the other side learned A.G.A. submits that both the offences are compoundable and if the parties have settled their dispute the continuation of proceeding amounts to be a futile exercise. 9. After hearing the learned counsel for the applicant as well as the learned A.G.A. and taking into consideration that that both the offences are compoundable and parties have settled their dispute amicably, the instant petition as well as the compounding application deserves to be allowed. 10. Accordingly, the instant application preferred under section 528 of BNSS, 2023 and the compounding application are allowed and the entire proceeding of Criminal Case No. 58 of 2025 ‘State of Shanti Devi’ pending in the court of learned Judicial Magistrate, Dehradun, is also hereby quashed.
