After some argument, Ms. Aprajita Bhardwaj, learned counsel for the petitioner seeks leave of this Court to withdraw this petition with a liberty to avail the aid of order dated 13.12.2010 passed in B.A. No. 9220 of 2010 wherein the Court has taken care of while imposing conditions from 20(a) to (e), particularly the condition no. (C) that ‘the applicant shall not leave the country till the trial complete. In the event of emergency, only after prior permission of the Court.’ 2. Learned counsel for the petitioner, however, has admitted the fact that no such application has been filed before the learned trial court seeking permission from the learned trial court. Therefore, she intends to withdraw the instant 2026:JHHC:11734 Page | 2 petition to avail the liberty as granted vide order dated 13.12.2010 passed in B.A. No. 9220 of 2010, as indicated hereinabove. 3. Such submission has been made in presence of learned counsel for the respondent-ED. 4. In view of submissions advanced by learned counsel for the petitioner, the instant petition is permitted to be withdrawn with liberty to the petitioner to file appropriate application before the court concerned. 5. It is made clear that if such application is filed by the petitioner the same shall be decided expeditiously in accordance with law after giving opportunity to the Opp. Party-ED. 6.
