JUSTICE BIPIN GUPTA Judgment / Order 14/05/2026 1. Learned counsel for the appellant submits that, under the garb of the stay order passed to the effect that the property in dispute may not be transferred and that status quo with regard to the record be maintained, the plaintiffs are not permitting him to enjoy the fruits of the property and are interfering with the construction. 2. Learned counsel for the appellant contends that, under the garb of the said order, the plaintiffs are obstructing the appellant from using the property and are interfering with the ongoing construction. 3. Heard. 4. This Court finds that a mere reading of the order makes it clear that there is no restraint regarding the status quo of the property itself; rather, the order is confined only to the extent of restraining transfer of the property and maintaining the status of [2026:RJ-JP:20449] (3 of 3) [CMA-3706/2025] the record, and not the status of the site. Therefore, the apprehension raised is baseless. 5. With the above observations, the present Civil Miscellaneous Appeal stands disposed of. 6. Pending application(s), if any, also stand disposed of.
