The facts of the case, as projected by the petitioner, are that he was recorded owner of land bearing Khasra No.46, area 0.016 hectares, which was acquired for the construction of a Canal under the Kelo Project, vide award dated 08.08.2019 passed by respondent No.3. Although compensation has been determined, but the benefit as provided under Paragraph 4(b) of the Schedule-II of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (henceforth referred to as “Act, 2013”) has not been provided to the petitioner. Therefore, the petitioner has submitted a representation (Annexure P-2) before respondent No.3; however, the same has not been decided yet. Hence, respondent No.3 be directed to decide the said representation filed by the petitioner. 3. Though counsel for the petitioner is not present on behalf of the petitioner, but considering the limited relief sought by petitioner, instead of keeping the instant writ petition pending, the same is disposed of directing Respondent No.3 / the Land Acquisition Officer -cum-Sub Divisional Officer (Revenue), Raigarh, District Raigarh, to decide the representation (Annexure P-2) filed by the petitioner in accordance with law, as early as possible, preferably within a period of 60 days from the date of receipt/submission of a copy of this order, if it has not already been decided.
