Act proceeding have decided to withdraw the proceeding from the Trial Court, therefore, the proceeding which is challenged in this petition be closed. He further submits that the instruction with regard to withdrawal of proceeding of Complaint Case No. 1000 of 2024, M/s Cholamandalam Investment and Finance Company Ltd. Vs. Ahmad Miyan, pending in the court of Addl. Chief Judicial Magistrate, Khatima District Udham Singh Nagar has been sent through mail by the respondent. 4. Since, now the counsel for the respondent on instructions which he has received through mail, apprise to this Court that respondent/complainant have now decided to withdraw the pending proceeding, therefore, in such view of the matter proceeding of instant petition is closed and the respondent is directed to make a request for withdrawal of the proceeding before the Trial Court. 5.
