GP FOR REGISTRATION AND STAMPS The Court made the following Judgment: 3 THE HONOURABLE SRI JUSTICE RAVI NATH TILHARI THE HONOURABLE SRI JUSTICE PURUSHOTTAM KUMAR CHINTALAPUDI WRIT APPEAL NO: 704 OF 2026 ORDER: (per Ravi Nath Tilhari, J) Heard Sri V. R. Reddy Kovvuri, learned counsel for the writ appellant and learned Government Pleader for the respondents 1 to 7. 2. The Writ Petition No.14493 of 2026 was filed assailing the proceedings of the District Collector, Y.S.R. Kadapa District, dated 27.04.2026, by which the previous proceedings dated 04.06.2020 and 03.06.2020 were kept in abeyance in respect of the subject land. 3. Learned counsel submits that the application for grant of interim relief is pending and the same has not been decided finally. 4. The order under challenge in the present Writ Appeal dated 14.05.2026, reads as under: “For filing counter-affidavit, list the matter on 04.06.2026. Any order to be passed by the Tahsildar to the directions given by the District Collector is subject to the result of the writ petition.” 5. We are of the view that the learned Single Judge, was not inclined to pass the interim order as might have been prayed, at the stage, without counter-affidavit and so called for the counter-affidavit. However at the same time, it was also provided that the order passed by the Tahsildar to the directions given by the District Collector, shall be subject to the result of the Writ Petition. 4 6. We find no justification to interfere with the said order in exercise of the Appellate Jurisdiction, at this stage when the interim relief application is said to be pending in the writ petition, which needs consideration finally after filing of the counter-affidavit. 7. The respondents in the writ petition have not filed counter-affidavit. 8. Learned counsel for the petitioner submits that the respondents shall file the counter-affidavit in the writ petition within a period of two weeks from today as requested. 9. Considering the aforesaid, this Writ Appeal is disposed of providing that the writ appellant’s/petitioner’s application for interim relief in the writ petition deserves to be considered on filing of the counter-affidavit in the writ petition. 10. We clarify that we have not expressed anything on the merits of the claim in the writ petition or on interim relief matter. No order as to costs.
