09/29.04.2026 Heard the learned counsel appearing on behalf of the parties.

Learned counsel for the petitioner submits that the petitioner is in custody in connection with Untari Road P.S. Case No. 06 of 2024 for the offences registered under Sections 302/34 of the IPC, pending in the court of learned Judicial Magistrate, 1st Class, Palamau.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case only because the victim had filed one case being Untari Road Thana Case No. 08 of 2023 dated 07.04.2023 under Sections 354/354(D) of IPC. He submits that except suspicion, there is nothing to connect the petitioner with the alleged offence. He has further submitted that the alleged confessional statement of the petitioner has been recorded after one year of occurrence and though it has been stated that the murder weapon was recovered from the house but the murder weapon was also not sent for any FSL examination. The petitioner is in custody since 21.08.2025.

Learned counsel for the opposite party-State has opposed the prayer and has submitted that there was no need to send the murder weapon for FSL examination as the incident had taken place one year back. However, the submissions made by the learned counsel for the petitioner is not in dispute.

After hearing the learned counsel for the parties and considering the aforesaid facts and circumstances, the petitioner above named is directed to be enlarged on bail on his furnishing bail bond of Rs. 25,000/- (Rs. Twenty-five thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st

Class, Palamau, in connection with Untari Road P.S. Case No. 06 of 2024, on the following conditions: (i) One of the bailors would be the present pairvikar of the petitioner. (ii) The other bailor should be his close relative. (iii) The petitioner will attend the court on each and every date and on account of his single default, the learned court shall cancel the bail bond furnished by the petitioner. (iv) The petitioner will deposit a self-attested copy of his Aadhar Card along with his mobile number before the learned court which he will not change during the pendency of the case without prior permission of the court. (v) The petitioner shall fully co-operate with the proceedings before the learned court below.
6. Let this order along with a copy of the affidavit filed with the bail petition be communicated to the court concerned through FAX/e- mail.
7. The instant bail application is allowed with the aforesaid conditions.
