By means of the present Criminal Writ Petition, the petitioner seeks quashing of the impugned F.I.R. dated 26.04.2026, registered as Case Crime No. 236 of 2026, under Sections 8 and 21 of the Narcotic Drugs and Psychotropic Substances Act, 1985, at Police Station Manglour, District Haridwar. The petitioner has also prayed that the respondents be directed not to arrest him in connection with the aforesaid case crime. 3. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case. It is contended that the petitioner was neither apprehended from the spot nor involved in the commission of the alleged offence. It is further submitted that the petitioner is not named in the F.I.R. and has been implicated solely on the basis of the alleged confessional statement of the co- accused who were apprehended from the spot. Learned counsel further submits that no specific role has been assigned to the petitioner in the F.I.R. He, however, submits that the petitioner is now ready and willing to surrender before the court concerned and seeks liberty to do so. 4. Learned State Counsel submits that he has no objection if the petitioner is permitted to surrender before the court concerned. 5. After arguing the matter at length, learned counsel for the petitioner seeks permission to withdraw the present writ petition with liberty to surrender before the court concerned. 6. In view of the aforesaid, the present Criminal Writ Petition is dismissed as withdrawn with liberty to the petitioner to surrender before the court concerned within a period of one month from today. In the event the petitioner surrenders within the aforesaid period, he shall not be arrested pursuant to the impugned F.I.R. dated 26.04.2026, provided he continues to cooperate with the investigation. Upon his surrender, it shall be open to the petitioner to seek appropriate relief before the competent court in accordance with law.
