Rakib (Allowed) CRM (NDPS) 519 of 2026 In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Kaliachak Police Station case no. 1722 of 2025 dated 05.10.2025 under Sections 21(c)/25/27A/29 of the Narcotic Drugs Psychotropic Substances Act, 1985. And In the matter of : Bablu Pramanik @ Napit. ……Petitioner. Mr. Md. Wasim Akram ……for the Petitioner. Mr. Ranabir Roy Chowdhury Ms. Suchismita Dutta ……for the State. Learned advocate appearing for the petitioner submits that petitioner has been implicated on the basis of statement of co-accused and there is no recovery from him. Although, the subject matter of the case relate to alleged recovery of 94 bottles of RC cough syrup. Learned advocate for the State opposes the prayer for bail. However, learned advocate for the State is unable to refute the contention relating to complicity of the petitioner which is on the basis of statement of co-accused and no recovery having been effected from the petitioner. There are call data records as has been reported by the learned advocate for the State on a query from this Court. Having considered the same, I am inclined to release the petitioner on bail. Accordingly, the prayer for bail of the petitioner is allowed. 2 Accordingly, petitioners namely, Bablu Pramanik @ Napit shall be released on bail upon furnishing bond of Rs. 20,000/- (Rupees Twenty Thousand only), with two sureties of Rs. 10,000 (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction of the learned Judge, Special Court cum learned Additional District Judge, 4th Court, Malda. If on bail, the petitioner shall be physically present before the learned Special Court on each and every date and shall not leave the jurisdiction of District of Malda without the prior permission of the learned Special Court. Accordingly, CRM (NDPS) 519 of 2026 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
