For Respondent No. 3 : Dr. Sudeep Agrawal, Advocate Hon’ble Shri Justice Rakesh Mohan Pandey Judgment On Board 25.4.2026 1) By way of this petition, petitioner has sought following reliefs:- 10.1 The Hon'ble Court may kindly be pleased to call for the entire records pertaining to this case 2 from possession of the respondents for it's kind perusal; 10.2 The Hon'ble Court may kindly be pleased to issue a suitable writ/order/direction commanding the respondents to conclude/finalize the process initiated in the year 2016 for promotion from the post of Deputy Superintendent of Prison (Gazetted) to the post of Superintendant District Jail (Class-II); 10.3 The Hon'ble Court may kindly be pleased to issue a suitable writ/order/direction commanding the respondents to keep in abeyance the new process initiated recently for promotion from the post of Deputy Superintendent of Prison (Gazetted) to the post of Superintendant District Jail (Class-II) unless and until the process initiated in the year 2016 for promotion from the post of Deputy Superintendent of Prison (Gazetted) to the post of Superintendant District Jail (Class-II) is not concluded/finalized; 10.4 The Hon'ble Court may kindly be pleased to issue a suitable writ/order/direction commanding the respondents to grant promotion to the petitioner from the post of Deputy Superintendent of Prison (Gazetted) to the post of Superintendant District Jail (Class-II) with effect from 01.04.2016 or with effect from any suitable date with all consequential benefits; and 10.5 Any other relief, which this Hon'ble Court may deem fit and proper, may also be passed in favour of the petitioner. 2) Mr. 2) Mr. Rishi Rahul Soni, learned counsel for the petitioner submits that at present, the petitioner is posted as Deputy Superintendent of Prison (Gazetted) and he is eligible for promotion to the post of Superintendent, District Jail (Class-II) since year 2016. He further submits that department initiated process for promotion to the post of Superintendent in the year 2016 but till date said process has not been concluded for the reasons best known to the respondent 3 authorities. 3) On the other hand, Mr. Anmol Sharma, learned State counsel would oppose. 4) Dr. Sudeep Agrawal, learned counsel appearing for respondent No. 3-CGPSC submits that respondent No. 3 sent various letters to the Department of Home Affairs to provide the necessary information and number of eligible candidates but till date no response has been given. He has referred the letters sent to the respondent No. 1-department dated 18.10.2016, 16.1.2017, 9.3.2017, 6.6.2017, 14.6.2017, 24.6.2017 and 31.7.2017. He further submits that if the respondent No. 1-department would provide the necessary information, CGPSC would finalize the proceeding of DPC. 5) I have heard learned counsel for the parties and perused the documents placed on record with utmost circumspection. 6) Taking into consideration the fact that there is negligence on the part of respondent No. 1-department in providing the necessary information to the respondent No.3-CGPSC, therefore without expressing any opinion on the merits of the case, this petition is hereby being disposed directing Secretary, Home (Jail) Department, State of Chhattisgarh to provide the information sought by the respondent No. 3 in aforestated letters within period of 45 days from today and thereafter respondent No. 3 shall convene the DPC within further period of 90 days and take 4 decision accordingly with regard to promotion of petitioner and other eligible candidates from the post of Deputy Superintendent of Prison (Gazetted) to Superintendent, District Jail (Class-II). 7) With the aforesaid direction, this petition stands disposed.
