2. The petitioner is an accused in a case registered for the offence punishable under Sections 126(2), 115(2), 118(1)(2), 74, 76, 109, 303(2), 351(2), 352 & 3(5) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
3. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case and has not committed any offence as alleged in the F.I.R. The informant while lodging the FIR, has exaggerated the incident and has made false allegation against the petitioner and other co-accused persons. There is case and counter case between the parties. The petitioner and the informant are neighbours and the alleged incident took place in the heat of the moment on trivial issues. The petitioner had no intention to inflict injury upon any one. The petitioner is in judicial custody since 25.02.2026. Hence, he may be given the privilege of regular bail.

Learned A.P.P while opposing the petitioner’s prayer for bail, submits that on perusal of the written report, it would be evident that there is direct allegation against the petitioner that he assaulted the informant’s parents on their heads by means of an axe, as a result of which, they sustained injuries. Their injury reports suggest that they had sustained grievous injuries.
5. Having heard learned cornel for the parties and considering that there is direct allegation against the petitioner that he, by means of an axe, assaulted the informant’s parents on the vital part of their bodies, due to which they
2026:JHHC:12803 sustained grievous injuries, I am not inclined to grant bail to the petitioner in connection with Jamua P.S. Case No. 50/2026.
6. The prayer for bail of the above named petitioner is accordingly rejected.
