Heard the learned Advocate for the applicant and the learned Advocate appearing for the original Complainant as well as the learned APP appearing for the Respondent/State. 2. The present application filed by the applicant for regular bail and this is a 3rd attempt of the applicant to secure the bail on merits. The learned Advocate for the applicant at present without addressing the Court on merits submitted that the present applicant has been arrested on 13.06.2024 in connection with the Crime No.-521 of 2024 registered at Shevgaon Police Station, District Ahilyanagar, for the offences punishable under Sections 420, 406, 409 r/w 34 of the Indian Penal 2 960ba498.26 Code alongwith Section 3 of the Maharashtra Protection of Interest of Depositors (in Financial Establishments) Act, 1999 (for short “MPID”) Act. 3. The learned Advocate for the applicant submits that after taking into consideration the period of custody that the applicant has already undergone in this case. The applicant is ready and willing to deposit an amount of Rs. 5 lakhs at the time of his release on bail for temporary period of 2 months and within the said period of his temporary release he will arrange for the amount of Rs. 50 lakhs and deposit the same in the trial Court. 4. The learned Advocate for the respondent though opposed offer by stating that applicant’s application on merits has been rejected by this Court on 2 occasions and there is no change in the circumstance that has been brought on record. 5. The learned APP for the State also opposed on the same ground. 6. After hearing the learned Advocates for the parties and after taking into consideration that the applicant is arrested on 13.06.2024 coupled with the fact that the entire investigation is now complete and the custody of the applicant for the purpose of investigation is absolutely not necessary. I think it is appropriate to grant temporary bail to the applicant for a period of 88 days from the date of his release as by way of interim relief. 7. The main application shall be kept pending so as to find out as to whether the statement and assurance given to this Court by the applicant is bonafidly abide. Hence the following order : 3 960ba498.26 ORDER (i) The interim Bail Application is allowed. (ii) The applicants shall be released on bail in Crime No. I- 521 of 2024 registered at Shevgaon Police Station, District Ahilyanagar, for the offences punishable under Sections 420, 406, 409 r/w 34 of the Indian Penal Code alongwith Section 3 of the Maharashtra Protection of Interest of Depositors (in Financial Establishments) Act, 1999 (for short “MPID”) Act. on furnishing a personal bond of Rs. 50,000/- (Rupees Fifty Thousand only) with one solvent surety in the like amount, for a period of 88 days from the date of his release on following conditions : a) The applicant shall deposit an amount of Rs. 5 Lakhs (Rs. Five Lakhs Only) in the trial Court at the time of his bail sureties and only thereafter the learned trial Court shall issue bail Writ in favour of the applicant. b) Upon release of the applicant, within a period of 88 days the applicant shall deposit an amount of Rs. 50 Lakhs in the trial Court and submit an affidavit of compliance in this Court alongwith the receipt of the said deposit on or before the next date. c) On expiry of 88 days, upon failure to deposit of amount of Rs. 50 Lakhs the applicant shall immediately surrender to the jail custody. If the applicant fails to surrender on or before of 88th day from the date of his release, the jail authority and the investigating officer will be a liberty to re-arrest the applicant and send him to the custody. d) List the matter on 26.11.2026. e) If the amount of Rs. 50 Lakhs is deposited by the applicant the same shall be apportioned amongst the beneficiaries by the trial Court in accordance with the law. f) The applicant shall attend the concerned Police Station on every Monday in between 11.00 to 2.00 p.m. and 4 960ba498.26 mark his presence before the Investigating Officer, unless his attendance is specifically exempted. g) The applicant shall not leave the jurisdiction of this Court without permission of this Court. h) The applicant shall not, directly or indirectly, contact, threaten, induce or influence the informant or any prosecution witness and shall not tamper with the prosecution evidence. i) The applicant shall furnish his current residential addresses and mobile numbers to the Investigating Officer and the trial Court within seven days of release, intimate any change forthwith, and attend the Investigating Officer upon prior written notice if further investigation is required. j) The applicant shall not leave India without prior permission of the trial Court and, if he possess passports, shall deposit the same with the trial Court within seven days of their release. k) The applicant shall not involve himself in any offence of a similar nature while on bail. l) Breach of any of the above conditions shall entitle the prosecution to apply for cancellation of bail. m) All observations in this order are prima facie and confined to the decision of this bail application. The trial Court shall decide the case independently on the evidence led before it. n) The Bail Application and the pending Criminal Applications are disposed of in the above terms. (HITEN S.
