The petitioner is apprehending his arrest in connection with Bishrampur PS Case No.21 of 2023, for offence registered under section 414, 272, 273, 120B of the IPC and Section 47 (a) of Jharkhand Excise Act, pending in court of learned Judicial Magistrate First Class Palamau. 3. Learned counsel for petitioner submits that petitioner is not named in the FIR and the petitioner happened to be owner of truck and the allegations are made of carrying foreign liquor on said truck. He next submits that since the petitioner is owner of said truck and in view of that, name of the petitioner has surfaced in course of investigation and the petitioner has got no criminal antecedent as disclosed in paragraph 10. 4. Learned State counsel opposes prayer and submits that the 2026:JHHC:12572 -2- A.B.A. No. 1912 of 2026 liquor has been recovered from the truck in question. 5. Considering that the petitioner is owner of the truck in question and having no criminal antecedent as aforesaid and name of the petitioner has surfaced in course of investigation, I am inclined to grant anticipatory bail to the petitioner. 6. Accordingly, the petitioner, above named, is hereby directed to surrender before learned court within two weeks from today, and in event of his surrender/arrest, the petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of like amount each, to the satisfaction of learned Judicial Magistrate First Class Palamau, in connection with Bishrampur PS Case No.21 of 2023, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023.
